Introduction
As a small claims court expert, I deal with hundreds upon hundreds of inquires from people with small claims court questions. While I am gratified that my advice is sought and am pleased to assist those with legal problems, I never cease to be amazed at of some of the questions I receive on a daily basis. The following 3 questions are some of the biggest offenders on my “impossible to accurately answer “ list.
Question 1 - "What are my chances of winning?"
I would say 70-30. Does that make you feel better? The fact of the matter is that it is impossible to accurately predict how a judge will decide a small claims case no matter how strong or weak a case is. I have seen what appeared to be air-tight cases lose, and what appear to be loser cases, win. It is not as if we legal professionals walk around with statistics in our back pocket. To echo Dana Carvey's skit on George Bush discussing paper towels versus dryers..."Discussing strengths and weaknesses of a case – gooooood. Asking for chances of success – baaaaaad.
Question 2 - "Have you ever handled "this" type of case?"
I chuckle every time someone asks me if I have handled a fact situation like the one he is contacting me about. Every client thinks that his dispute is unique. However, the fact of the matter is I inevitably have to burst someone’s bubble at least once a day to assure someone that regardless of the context, his case is no different in principle then the hundreds of others I deal with. Out of the numerous cases I receive each week, there is maybe one, maybe, which is something I have never seen before within a legal context. So, if someone asks if I have ever dealt with his particular case where his mother's sister's uncle's aunt breached a contract and wants to sue, no, but have I dealt with breach of contract cases before - you bet.
Question 3 - "I have no address for the debtor but can I still sue?"
I am always amazed at this question. Can you sue? Sure. But what will you then do with the lawsuit when you can't find the person whom you have to serve!
