Jordan Farkas Article Spurs Change to Rules of Service!

In a recent article published by the Law Times, I bemoaned the 2010 change to service in the Rules of the Small Claims Court where a Defendant himself had to verify receipt of a claim served by registered mail or courier.  One of my arguments against this was that defendants were allowing other family members to sign off which allowed defendants to evade service. 

Well, the small claims court has listened and changed the rule to allow verified receipt by any person who appears to be a member of the same household as the defendant. 

While I believe other methods of service should be allowed such as fax, this change is definitely a step in the right direction…and I am taking credit for it whether the Small Claims Court likes it or not!
